New Delhi. The Supreme Court heard the Kolkata trainee doctor murder case again on Monday. The court sought a status report from the CBI and after seeing it, raised many questions. The court has also directed the CBI to submit a fresh status report by September 17.
The bench said that a status report has been filed by the CBI, it appears that the investigation is in progress. We direct the CBI to file a new status report. We do not want to guide the CBI in its investigation. Mehta told the bench that the investigating agency has decided to send forensic samples to AIIMS for further investigation.
CJI said- why was there a delay of 14 hours in the FIR?
The lawyer said that an FIR should have been registered immediately based on the information given by the person who first saw the dead body. The CJI said to this that of course, there was a delay of at least 14 hours. The solicitor said that today Sibal also had to explain why Dr Ghosh was immediately given another appointment, but we did not discuss this today.
Did the person doing the postmortem do an X-ray?
The lawyer said that the girl’s leg was bent at a 90 degree angle. This can happen due to a broken hip bone. Did the postmortem examine the body through an X-ray? On this, Sibal said that we had given the dead body challan to the family. We don’t have a copy of it yet. Hearing this, the CJI said that this copy is important. It records what clothes the victim was wearing and what else was found on the body. The lawyer said that without this information, the doctor cannot accept the body for postmortem.
Apart from this, clarity is also needed on when the death occurred. The CJI agreed and said that of course, it is also important to know when the body was first seen.
Justice Pardiwala raised questions on the report of CFSL West Bengal
After the lawyer’s questions, the solicitor said that the postmortem report says that the death was due to rape and strangulation. We are sending the sample to another lab. On this, the lawyer said that the problem is that the doctor who did the postmortem did not find the body in the condition in which it was found. Justice Pardiwala questioned the report of CFSL West Bengal. He asked the solicitor to read the first line in his mind. The solicitor said that the delay from finding the body to the postmortem is within the scope of our investigation.
The lawyer said that the doctors who did the postmortem had to keep the vaginal swab safe at 4 degrees temperature, but they did not do so. The solicitor said that the crime scene remained open for 5 hours after the death was discovered. Anyone was coming and going there. There is also a possibility of evidence getting destroyed.
